Today at the Intertribal Agriculture Council’s Eastern Region Summit in Richmond, VA, Jessie Barrington (Chair of CHP’s Tribal Nations Practice) broke down “Trespass on Indian Agricultural Land,” showing Tribal Nations how far AIARMA’s trespass protections really reach (from expired rights-of-way to drone overflights and water contamination) and what a trespasser owes once you enforce: treble damages, resource repair, and attorney fees. She also argued that Tribes don’t have to wait on an under-resourced BIA; instead, they can adopt the regulations and run the entire enforcement program in their own court.
