The Advisory Council on Historic Preservation’s proposed Amendments to the Implementing Regulations for Section 106 of the National Historic Preservation Act (RIN 3010-AA10) are under review at the Office of Information and Regulatory Affairs (OIRA). ACHP is scheduled to vote on their proposed changes to Section 106 on Nov. 10, 2026. This is one of the last chances to weigh in before the proposed rule is published for public comment.
Under Executive Order 12866, any stakeholder can request a meeting with OIRA while a rule is under review. Others are already doing so: 48 meetings have been logged on this rule, with more scheduled for October 27, 28, and 29 and November 3, 2026. If you care about how federal projects affect historic places, tribal cultural resources, and community consultation, your perspective needs to be in that room too.
What to do:
- Request an EO 12866 meeting through Reginfo.gov, referencing RIN 3010-AA10.
- Prepare 2–3 key points on how the changes would affect your community, sites, or consultation role, plus any supporting materials (these are posted publicly).
- Act quickly. Meetings happen only while the rule is under review, and the window could close at any time.
We urge organizations and individuals who have not yet scheduled a meeting to do so! You can review our update about the meeting Cultural Heritage Partners held with OIRA, and you can look at the materials others submitted to OIRA.
