On Friday, September 11, 2026, Cultural Heritage Partners (“CHP”) submitted an expedited Freedom of Information Act (“FOIA”) request to the Advisory Council on Historic Preservation (“ACHP”).. The request seeks to identify who drafted the proposed amendments to Section 106 and who participated in internal discussions about the July 17, 2026 redline of those amendments. CHP requested ACHP’s complete record on the proposed rule, including drafts, internal memoranda, and records of the Council’s vote. CHP also requested ACHP’s communications about the rule with other federal offices, including the White House, the Office of Management and Budget, and the Department of the Interior.
For the July 17 redline, CHP asked for the original electronic file with its embedded information preserved, such as the author’s name, the editing history, and any tracked changes, along with any records showing who prepared the document and how ACHP received it. CHP also requested Vice Chairman Travis Voyles’s emails and text messages about the redline, whether he sent them from his ACHP account, an Environmental Protection Agency account, or a personal account or device. Under law, ACHP has 10 days to respond.
